Willow Creek Counseling (“we,” “our,” or “us”) is committed to protecting the privacy of visitors to our website at www.willowcreekhealth.com (the “Site”). This Privacy Policy explains what information we collect through the Site, how we use it, and your choices regarding that information.
This Privacy Policy applies only to information collected through the Site itself. It does not apply to information collected through our clinical services, which is governed by our Notice of Privacy Practices (HIPAA) and applicable federal and state law, including 42 CFR Part 2 for substance use disorder records. If you are a current or prospective client, please refer to your intake documents for information about how your protected health information (PHI) is used and disclosed.

We collect personal information that you voluntarily provide when you interact with the Site, including:

Information you provide on that platform is governed by Simple Practice’s own privacy policy.

All clinical information is collected and stored exclusively through our HIPAA-compliant electronic health record system (Simple Practice) and is subject to our Notice of Privacy Practices.

Payment Processor (CareCredit / Synchrony Bank): If you apply for CareCredit financing through a link on our Site, you are redirected to CareCredit’s website. Information you provide to CareCredit is governed by their privacy policy and the terms of Synchrony Bank.

Email Service Providers: If you subscribe to our email list, your email address may be processed by our email marketing service provider to deliver newsletters.

Contact form submissions and email subscription data are retained until you request deletion or unsubscribe. Analytics data is retained in aggregate form and does not identify individual users after processing.

The Site is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 through the Site. If we learn that we have inadvertently collected such information, we will take steps to delete it promptly. This section applies to information collected through the website only. Our clinical services for minors are governed by separate informed consent and HIPAA requirements, as described in our Practice Policies and Procedures.
11. Idaho and State-Specific Disclosures
Willow Creek Counseling is located in Twin Falls, Idaho, and primarily serves clients in the State of Idaho. Idaho does not currently have a comprehensive consumer data privacy statute equivalent to the California Consumer Privacy Act (CCPA). However, we are committed to transparency about our data practices and will update this policy if Idaho or any applicable state enacts additional privacy requirements.
If you are a California resident, you may have additional rights under the CCPA. Please contact us for more information.
12. Relationship to HIPAA Notice of Privacy Practices

This Privacy Policy governs information collected through the website only.
Your protected health information (PHI) is governed by our Notice of Privacy Practices (NPP), which is provided during intake.
If you have questions about how your clinical records, diagnoses, or treatment information are used and disclosed, please refer to the NPP or contact us directly.
For clients with SUD records subject to 42 CFR Part 2, additional protections apply as described in our Practice Policies and Procedures.
13. Changes to This Privacy Policy
We reserve the right to update this Privacy Policy at any time. Changes will be posted on this page with an updated “Last Updated” date. We encourage you to review this policy periodically. Your continued use of the Site after changes are posted constitutes acceptance of the revised policy.

By accessing and using the website located at www.willowcreekhealth.com (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you should not access or use the Site. These Terms constitute a legally binding agreement between you and Couch Mental Health, LLC DBA Willow Creek Counseling (“we,” “our,” or “us”).
2. About the Site
The Site is operated by Couch Mental Health, LLC DBA Willow Creek Counseling, a mental health counseling practice located at 1426 Addison Ave E, Suite A, Twin Falls, Idaho 83301. The Site provides general information about our counseling services, including EMDR intensives, couples intensives, extended sessions, and related educational content. The Site also provides access to scheduling tools, a blog, a newsletter signup, and links to third-party resources.
3. No Therapist-Client Relationship
IMPORTANT NOTICE
Browsing the Site, reading blog content, submitting a contact form, or scheduling a free phone consultation does NOT establish a therapist-client relationship.
A therapist-client relationship is established only after the completion of intake paperwork, informed consent, and a mutual agreement to begin treatment.
Nothing on the Site constitutes professional clinical advice, diagnosis, or treatment. The content is for general informational and educational purposes only.
If you are experiencing a mental health emergency, call 988 (Suicide & Crisis Lifeline), call 911, or go to your nearest emergency room. Do not use the Site or contact forms for emergencies.

5. Scheduling and Free Consultations
The Site includes links to schedule a free phone consultation through our secure client portal hosted by Simple Practice (kathycouch.clientsecure.me). When you click a scheduling link, you are redirected to Simple Practice’s platform. Your use of that platform is governed by Simple Practice’s terms of service and privacy policy.
A free phone consultation is an opportunity to discuss our services, assess goodness of fit, and determine candidacy for our programs. It is not a therapy session and does not establish a therapist-client relationship. No clinical advice, diagnosis, or treatment is provided during free consultations.
6. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos (including the Willow Creek Counseling logo), photographs, blog articles, icons, and design elements, is the property of Couch Mental Health, LLC or its content suppliers and is protected by United States copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or transmit any material from the Site without prior written consent from Willow Creek Counseling, except as follows:

9. Online Store (Rewired360.shop)
The Site links to an online store at www.rewired360.shop. Purchases made through this store are governed by the terms, policies, and privacy practices of that platform. Willow Creek Counseling is not responsible for transactions, refunds, shipping, or disputes arising from purchases made through Rewired360.shop, which is operated as a separate business entity.
10. Geographic Limitations
Willow Creek Counseling is licensed to provide clinical services in the State of Idaho. Clients must be physically located in Idaho at the time of all clinical sessions (both in-person and telehealth). The Site may be accessed from anywhere, but clinical services are available only to individuals located in Idaho unless otherwise specified.
Oregon licensure is pending. The Site will be updated when additional state licenses are obtained.
11. Disclaimers
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the content on the Site is accurate, complete, or current.
12. Limitation of Liability

Our total liability to you for any claims arising from your use of the Site shall not exceed one hundred dollars ($100.00). This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).
This limitation of liability does not apply to our clinical services, which are governed by separate informed consent, malpractice, and liability frameworks.

You agree to indemnify, defend, and hold harmless Couch Mental Health, LLC, its owner, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any third-party rights.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Twin Falls County, Idaho, and you consent to the jurisdiction and venue of such courts.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
